According to The Guardian, Ben denies all these claims and is suing three publications on the basis of diminishing his character and reporting what he claims is not true.

Now, these incidents date back to April 2009 where Australian troops were cleaning a compound. At this time, two men were caught hiding within it. One of which was a disabled man.

Ben denies all the claims made thus far

When the incident was over, the witness recalled Ben Roberts-Smith turning towards him saying, “Are we cool? He then proceeded to walk away from the body. The witness did not attempt to examine the body but recalls seeing a lot of blood.   He did not comment on whether the man had a prosthetic leg or not.

Ben ordered a soldier to kill an elderly man

The second incident happened after the witness was investing a room in the compound. He said that upon coming out of the room, he saw Ben and an individual called person 4 in the case. The two of them were standing before an elderly man before Ben kicked his legs so that he may be on his knees.

Ben then proceeded to order person 4 to shoot the elderly man in the head. This is when person 41 said he had gone back into the room because he did not want to witness the deed. He waited about 15 seconds later after hearing the gunshot to go back outside.

The witness testified that the individual was shot with an M4 rifle. He further expressed to the court that person 4 appeared to be in shock standing before the dead individual. Ben on the other hand was not in the vicinity after the elderly man was shot.
