Mariah Carey sued for copyright of All I want for Christmas is you

Mariah Carey and her co-writer Walter Afansief have been issued legal papers with regard to her 1994 hit single “All I want for Christmas is you”. 

Country singer Andy Stone sues Mariah Carey

Thus far, Mariah Carey has not responded to these claims as country singer Andy Stone believes the singer has committed a copyright infringement on her 1994 single. 

To date, Andy Stone believes that Mariah Carey has benefitted wrongly from his song that was released a decade earlier. The country singer is suing Mariah for $20 million. As he believes that Carey did not ask for permission to draw inspiration. 

According to Pop Sugar, Andy Stone does not have much to use in his lawsuit. So far, the only thing that is in similarity is the song titles. 

Alas, not much can be done if the lawsuit is based on the title of the song. Thus far, any title of a song is not subject to any copyrights. So far, there are many songs with the same title as copyrights that do not apply to song titles. 

Lawyer says the case is unlikely to go far

So far, a lawyer from Los Angeles shared that the case is unlikely to go far. As Andy’s lawyer would need good evidence that Mariah has taken anything from the song he released. 

“Song titles aren’t entitled to copyright protection, That’s why there are 177 works using the same title.”

Right now, there are no apparent similarities between the two songs as the one released by Andy Stone is much slower than Mariah’s which is more upbeat. Her song has received one billion streams on Spotify.

Andy currently believes that Mariah Carey earned undeserved profits for her song and “knowingly, willfully, and intentionally engaged in a campaign” to infringe copyright.
