Ask the experts – Indefinite Leave to Remain dates

Q: I am currently nearing the end of my five year work permit. I am not sure when I will qualify for Indefinite Leave to Remain as the date stamp on my original work permit approval letter to my employer differs from the date my Leave to Remain was issued in my passport for the five years? My passport date is a few months later.

 

A: The five year qualifying period for Indefinite Leave to Remain on the basis of Work Permit Employment is considered to have started: on the date when you were issued with both your Immigration Employment Document from Work Permits UK and Further Leave to Remain on the basis of the Immigration Employment Document. If these were issued with different start dates, the later date would be applicable. Therefore the date endorsed in your passport is the relevant date to work from.
